QUESTION: I have been married to my husband for 15 years. We are getting divorced. Do I get alimony from him?

ANSWER:     The answer to your question is “maybe”. Michigan law provides that in a divorce judgment, if the estate and effects awarded to a party are insufficient for suitable support, the court may award to either party spousal support. The court must consider numerous factors in making such an award including, but not limited to: the ability of the parties to pay, the parties’ past relations and conduct, length of the marriage, the parties’ ability to work, the parties’ ages, the parties’ needs and health, the prior standard of living of the parties, whether the parties support others, and the source and amount of property awarded to the parties in the divorce.

There is no mandated formula to determine spousal support, although there are some calculators available that can provide some guidelines for review. You and your attorney should carefully review the specific facts of your case, including other factors such as child support and property division when reviewing your chances of receiving spousal support, the length of time for which support is appropriate, and whether the support would be modifiable.
